Terms of Service

1. Who we are

"Risen," "we," "us" and "our" mean Majesty International, a U.S. 501(c)(3) nonprofit organization registered in Fishers, Indiana, which operates the Risen web design and website services program at risendesign.app. "You" means the business, ministry or organization using our services, and the person accepting these terms on its behalf.

By requesting a project, signing in to the client portal, or paying for any service, you agree to these terms. If you don't agree, please don't use our services.

2. Our services

• Websites: design, development, hosting, SSL, backups, changes on request through the client portal, and Google Business Profile setup.
• Business email: mailboxes on your own domain, provided through a third-party email hosting provider.
• FiveStar: software for sending Google review requests to your customers by email and, on plans that include it, text message.
• RisenWrite: researched blog posts drafted for your business and published only after you approve them.
• Risen Ads: prepaid credits for AI-written marketing copy, ad images built from your own product photos, and email layouts in the client portal. A software service; no physical goods are sold. See the Risen Ads credit terms.

We describe each service and its current price on our pricing page. We may improve or change features over time. If we make a change that materially reduces a paid service, we'll tell you in advance, and you can cancel.

3. Payment

Website donations

Your website is paid for with a one-time donation to Majesty International in an amount we agree on in writing before work starts. Because you receive a website in exchange, the tax-deductible portion of your gift may be limited to the amount, if any, by which it exceeds the value of the services you receive. We'll provide a written acknowledgment. Please consult your tax advisor.

Monthly services

Monthly services are billed in advance, in U.S. dollars, at the prices on our pricing page when you sign up. Payments are processed by Stripe, and your card or bank account is charged automatically each billing period until you cancel. We'll give you at least 30 days' notice of any price increase, and you can cancel before it takes effect. Monthly service fees are payments for services and are not charitable contributions.

Risen Ads credit packs

Credit packs are one-time card payments in U.S. dollars through Stripe, not subscriptions. Credits don't expire while your account is active. Credits for a creation that fails are returned automatically. Unused credits can be refunded within 14 days of purchase; used credits can't.

Late payment

If a payment fails, we'll let you know and try again. If it remains unpaid for 14 days, we may suspend the affected service until it's resolved. We won't delete your data because of a late payment without first giving you notice and a chance to export it.

4. Cancellation and refunds

• Monthly services are month to month with no long-term contract. Cancel any time by emailing hello@risendesign.app or through the client portal. Cancellation takes effect at the end of the current billing period, and you won't be charged again.
• Refunds: monthly fees already paid are not refunded for partial periods. If we charge you in error, or a service is unavailable for a significant part of a billing period because of a problem on our side, contact us within 30 days and we'll refund or credit the affected amount.
• Website donations are generally non-refundable once design work has begun. If we're unable to deliver the website we agreed to, we'll work with you on a fair resolution, which may include a full or partial refund.

5. Ownership

• Your domain is registered in your business's name. You keep it if you leave.
• Your content (text, photos, logos, customer lists and other materials you provide or approve) belongs to you. You give us permission to use it to provide the services.
• Your website: once your donation is complete, you may request a copy of your site's files and content if you move to another provider.
• Our software, including FiveStar, RisenWrite, the client portal, and our templates and tools, remains ours. You get the right to use it while your services are active.
• Portfolio: we may show your website in our portfolio and name you as a client unless you ask us not to.

6. Your responsibilities

• Provide accurate information, and only content you have the right to use.
• Keep your sign-in details secure and tell us about any unauthorized use.
• Review requests: only add customers who actually did business with you and agreed to be contacted. Ask every customer the same way (no "review gating"), never offer anything in exchange for a review, and follow Google's review policies and the FTC's rule on consumer reviews and testimonials.
• Text messages: only send text messages to customers who have given consent to receive them, and honor opt-outs (STOP). FiveStar records text consent for each customer and includes an unsubscribe link in every review request email.
• Email: don't use our email service for spam, bulk marketing without consent, phishing, or anything illegal. Follow the CAN-SPAM Act when sending commercial email.
• Don't use our services for unlawful, fraudulent, infringing, or abusive content or activity.

We may suspend a service that is being used in violation of these terms, or in a way that threatens the security or reputation of our systems, such as spam complaints that affect email delivery for other clients.

7. Third-party services

Our services rely on providers including Cloudflare (hosting and security), Stripe (payments), an email hosting provider, a text message provider, and Google (for review links and Business Profiles). Their own terms may also apply. We're not responsible for changes these providers make, such as changes to Google's review or search policies.

8. Availability and backups

We work hard to keep everything running and backed up, but we don't guarantee uninterrupted service, specific search rankings, or a particular number of reviews or customers. No one can guarantee a #1 ranking on Google.

9. Disclaimers and limitation of liability

Except as stated in these terms, our services are provided "as is." To the fullest extent permitted by law, we're not liable for indirect, incidental, special or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us for the affected service in the 12 months before the claim.

10. Ending services

You can stop any service as described above. We may end services with 30 days' written notice, or immediately for serious or repeated violations of these terms. When services end, we'll help you move your domain, website files and email to another provider, and give you reasonable time to export your data before it's deleted.

11. Changes to these terms

We may update these terms from time to time. We'll post the new version here with a new effective date, and tell active clients about material changes by email at least 30 days before they take effect.

12. Governing law

These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts serving Hamilton County, Indiana.
